On December 22, 2011, Disability Rights Wisconsin (DRW) wrote to the U. S. Department of Education, Office of Special Education and Rehabilitative Services, Office of Special Education Programs (OSEP) requesting an opinion on the applicability of the Least Restrictive Environment (LRE) requirements under Part B of the Individuals with Disabilities Education Act (IDEA) to transition work placements. In its response, OSEP answered a series of questions posed by DRW. OSEP’s responses are consistent with ACCSES’s principles and interpretations of the meaning and application of LRE in IDEA and other federal programs for individuals with disabilities such as Medicaid HCBS. OSEP, for instance, states that IDEA does not prohibit employment-related services and options including those provided in centers that serve primarily individuals with disabilities.
